  PROTEST FISTRAL v REGOLARITA II

As the boats were about to start Race 4 an incident occurred between Fistral and Regolarita II.

Regolarita II was to windward of Fistral and some other boats. As Regolarita II attempted to start, she bore away to leeward to make the starting line. Unfortunately Fistral and some other boats were to leeward. Regolarita II bore away astern of a smaller boat but her bow collided amidships with Fistral causing significant damage. Although Fistral suffered a major hole in the side of the boat, through good seamanship, she was able to safely return to Kuah Harbour.

At the subsequent hearing by the International Jury, Regolarita II was found to be at fault by not keeping clear as windward boat (Racing Rule 11). As Regolarita II retired, no further penalty was conferred on her.

As redress for the incident, the International Jury awarded Fistral average points for Race 4 and Race 5. The average points were calculated as the average of Fistral’s places in Races 1, 2 and 3. The International Jury also ruled that Fistral’s average points would not displace any other boat’s place. This means that in Races 4 and 5, there will be boats with equal scores to that of Fistral.
